Commissioner of Oaths
Municipal Clerks and designated officials act as Commissioners of Oaths. This means they are authorized by the Province to witness people swearing or affirming that the information in a document is true.
Their role is limited. They may only witness the signature and administer the oath or affirmation. They do not verify whether the information in the document is true. The responsibility for the content of the document remains entirely with the person signing it.
Commissioners of Oaths cannot help fill out affidavits, edit documents, provide legal advice, or explain how to complete a form. They also do not supply blank affidavit forms. If help is needed, the individual must contact the organization or person who requested the document.
Commissioners are not permitted to commission documents related to private business or personal matters.
All commissioning services are provided at the discretion of the Commissioner of Oaths. If there are concerns about the signer’s identity or the document’s content, the Commissioner may refuse to commission the document and may suggest seeking assistance from a legal professional.
The Village does not have a Notary Public on staff and therefore are unable to notarize documents.
Additionally, Commissioners cannot certify documents as “True Copy” unless it originated from the Village of Burk’s Falls Municipal Office.

- Sworn Statement for the Transfer of a Used Motor Vehicle in the Province of Ontario
- Affidavit of Proof of Loss of Motor vehicle/boat (from insurance company)
- Affidavit of Proof of Residency
- Affidavit of Unregistered Vehicle
- Statutory Declaration of Common-law Union (single signature)- Service Canada Form
- Application for Change of Sex Designation on a Birth Registration
Documents The Municipality Does Not Commission
- Wills, “Living Wills”, Codicils to Wills or Estate Settlement documents
- Power of Attorney
- Divorce, seperation, marriage, or cohabitation documents
- Custody documents
- Documents related to debt
- Real estate related documents, statements, transfer of land
- Court, legal, civil issue related documents
- Age of Majority or BYID Card application
- Documents requiring the signature of a Notary Public, Canadian or Foreign
- Child Travel Consent
- Invitation letters for a visitor’s VISA
- Amendment to Birth/Death/Marriage Certificate forms
- Travel Industry Council of Ontario- Affidavit of Customer Claimant
- Proof of loss insurance document
- Any document that is to be executed by an individual acting in their capacity as a Power of Attorney
- Documents that are in any language other than English will not be commissioned, as we cannot validate the information that is sworn.
Requirements
All Individuals named on the document are required to:
- Be present in person
- Present valid, original, government-issued photo identification (e.g., a driver’s licence)
- Swear or affirm that the contents of the document are true before a Commissioner of Oaths
Fees
Fees are subject to our fees by-law and are payable by cash, debit, electronic transfer, or cheque.
