THE VILLAGE OF BURK’S FALLS
COUNCIL MINUTES


The regular meeting of the Burk’s Falls Council was called to order at 7:00pm on Tuesday, March 24, 2009. Present were Reeve Cathy Still, Councillors Bruce Campbell, Ron Russell, Rex Smith and Lewis Hodgson (7:25).

Delegations:
Bill Burke and Terry Hewitt attended to voice their concerns regarding excessive water drainage problems they perceive to occur because of the infilling at the property by Well #3. They would like to see Council develop an engineered plan to alleviate these water problems.
Rod Blakelock was present to discuss the building that was the former bookstore on Yonge St. Council will make a decision on the type of flooring etc. they wish installed.
Mr. and Mrs. Robert Boulerice were present for the opening of the sweeping tenders.
A tender will be advertised for garden maintenance for 2009. Perhaps “Welcome” banners will be placed on the poles with the planters.
Council went into a closed session to discuss personnel matters.
There were forty-three applications for the Deputy Clerk/Treasurer position and a meeting was set for March 31, 2009 at 7:00pm to set criteria and short list for interviews.

The Council for the Village of Burk’s Falls adopts the Minutes of the February 25, 2009 meeting as circulated.

2009-48
Lewis Hodgson – B. Campbell
The Council for the Village of Burk’s Falls approve the 2009 Budget for the Burk’s Falls Armour and Ryerson Union Public Library as presented in the amount of $ 108,424.00 with Burk’s Falls share being $20,509.00.

2009-49

Council for the Village of Burk’s Falls have read By-law 9-2009 being a by-law for the management, maintenance and regulation of the Village of Burk’s Falls waterworks/wastewater works;

And that Council authorizes the Reeve and the Clerk to sign this by-law and affix the Seal of the Corporation thereto.

That the Council for the Village of Burk’s Falls accepts the letter of resignation from Linda Maurer with regret.

The Council for the Village of Burk’s Falls have read the O.Reg. Section 11 Annual report for the Burk’s Falls Water Treatment Plant Waterworks No. 220000567.

The Council for the Village of Burk’s Falls approves the Tender from Spectrum Group for the purchase of VHF Mobile radios for a total of $ 1245.00 plus GST and PST.

The Council for the Village of Burk’s Falls approves the Tender from OCWA in the amount of
$ 7,500.00 to complete the operation plan of the Burk’s Falls Water Treatment Facility.

That the Council for the Village of Burk’s Falls accepts the tender from Mountain Cat Contracting Ltd. in the amount of $5,250.00 including GST for street sweeping in the Village.

The Council for the Village of Burk’s Falls have read the Emergency Response Plan as per the Amendment to Provisional Certificate of Approval for the Tri R Committee and accept the plan as presented.

2009-56

The Council for the Village of Burk’s Falls hereby accept the change to the landfill site hours of operation to include Mondays, from 12:00 p.m. to 5:00 p.m. during the winter season (September to May) commencing March 30, 2009;

And that this resolution be attached to By-Law 8-2008 as an amendment to Schedule “D”

2009-57

The Council for the Village of Burk’s Falls accepts the Accounts Payable as presented up to and including March 24, 2009 in the amount of $432,488.17 and hereby authorize the Clerk/Treasurer to issue cheques for same.

2009-58
The Council for the Village of Burk’s Falls have read and approve By-law 10-2009 being a by-law to appoint Michael D. Turner and His successor firm Pahapil and Associates Professional Corporation Chartered Accountants as Auditor of the Municipality;

And That Council authorize the Reeve and the Clerk to sign this by-law and affix the Seal of the Corporation thereto.

The Council for the Village of Burk’s Falls accept the offer of Occupational Health and Safety Assessment Service for the municipality from the Municipal Health & Safety Association as presented;
And that Council authorizes the Clerk/Treasurer to sign this offer on behalf of the municipality.

2009-60

The Council for the Village of Burk’s Falls agree to add water and sewer accounts to the property tax rolls to be collected in the same manner as taxes as these accounts have not been paid to date as per Schedule A attached.

That the Council for the Village of Burk’s Falls write off water and sewer accounts as per the Attached Schedule A as these accounts are deemed uncollectable.

The Council for the Village of Burk’s Falls have read the 2008 Annual Report of the Burk’s Falls Wastewater Treatment System prepared by the Ontario Clean Water Agency;

The Council for the Village of Burk’s Falls have read the resolution circulated by the Municipality of Thames Centre expressing concern with the global economic problems affecting the value of recycled materials and the viability of Blue Box programs.

And that the current WDO model provides 50% funding of the Blue Box program will not reimburse Municipalities for temporary program cost increases until 2011 leaving municipalities to finance portions of temporary costs.

Therefore we forward our support to the Municipality of Thames Centre for their presentation to the Provincial Government for consideration.

The Council for the Village of Burk’s Falls have read the resolution circulated by the City of Greater Sudbury expressing concern with the infrastructure gap per household for Northern Ontario municipalities;

And that many municipalities in Northern Ontario will see a reduction in their OMPF equal to their upload benefits resulting in very little net upload benefit for several years;

Now Therefore Be It Resolved that the Village of Burk’s Falls supports the petition to the Province of Ontario to increase the Northern Communities Grant by $ 50.00 per household to ensure all Municipalities in the North receive the necessary required support;

And that we forward our support to the City of Greater Sudbury for their presentation to the Premier of Ontario.

The Council for the Village of Burk’s Falls have read the resolution circulated by the City of Sault Ste. Marie expressing concern with the intent of the Northern Ontario School of Medicine and Ministry policies for medical specialists and resulting health care services, ensuring access to full health care services and specialties for the residents of Northern Ontario; and

That Council supports the concerns expressed in this document and forward our support to the City of Sault Ste. Marie for their presentation to the Minister of Health.

The Council for the Village of Burk’s Falls have read the resolution circulated by the Town of Mattawa to negotiate a more feasible and accessible cost sharing plan to allow all municipalities, regardless of their financial situation, to participate in the great opportunity;


And that we forward our support to the Town of Mattawa for their presentation to the Federal and Provincial government for consideration.

The Council for the Village of Burk’s Falls have read the resolution circulated by the Municipality of South Bruce expressing concern with the shortfall in provincial funding to the Ontario’s Conservation Authorities;

And that Council supports the concerns expressed in the resolution presented by the Municipality of South Bruce;

And that our support be sent to the Municipality of South Bruce for their presentation to the Premier of Ontario for consideration.

The Council for the Village of Burk’s Falls approve the application to conduct a Raffle Lottery as presented by the Armour Ryerson & Burk’s Falls Agricultural Society provided all regulations are adhered to.

As per the Municipal Act S.O. 2001, c.25 as amended, 239(2) Council for the Village of Burk’s Falls enters into a closed meeting at 21:10.

The Council for the Village of Burk’s Falls adopts the Minutes of the January 27, 2009 and February 25, 2009 Closed Session Minutes as read.

As per the Municipal Act S.O. 2001, c.25 as amended, 239(2) Council for the Village of Burk’s Falls exits from a closed meeting at 21:50.
