THE VILLAGE OF BURK’S FALLS
COUNCIL MINUTES

The regular meeting of the Burk’s Falls Council was held on Tuesday April 22, 2008 at 7:00 p.m in Council Chambers.
Members present were : Reeve Cathy Still, Councillors Ron Russell, Bruce Campbell, Rex Smith (7:10) and Lewis Hodgson (7:35).
Delegations to see Council: Linda Briant from the Coin Laundry expressing concern with the increase in water rates and the increase costs to operate her small business which relies heavily on water consumption (laundrymat). Bruce explained rationale for raising rates – there was no response at the Public Meeting and the rates were based on the information on hand at that time.

By-law Enforcement Officer Brian Darnbrough gave his report. He is continuing to take calls until the end of May. Mr. Jim Mahoney has been in discussions with Jarvis Osborne regarding taking over for Brian.

Village Foreman, Water/WasteWater operator Len Hall gave his report including roads, water, sewers, culverts, streetlights, trainings.

That we adopt the Minutes of the March 25, 2008 meeting as circulated.

Lewis Hodgson – B. Campbell:
That the Council for the Village of Burk’s Falls have read By-law 14-2008 being a by-law to enter into an agreement with other municipalities for the provision of fire prevention and public education services;

And that Council has reviewed the agreement attached to and forming part of this by-law and hereby authorize the Reeve and the Clerk to sign this by-law and affix the Seal of the Corporation thereto.

The Council for the Village of Burk’s Falls approve the application to conduct a Raffle Lottery as presented by the M.A. Wittick School Council provided all regulations are adhered to.

That we accept the Tender for Mid Western Line Striping Inc. as presented at the same rates as 2007.

That we accept the Tender from Grand & Toy in the amount of
$ 1,475.18 plus taxes for the purchase of a lap top computer.

The Council for the Village of Burk’s Falls have reviewed the correspondence from the Ministry of Transportation regarding the 2008 Municipal Road and bridge Infrastructure Investment fund in the amount of $ 24,950;

And that Council verify that the $24,950.00 allocated by the province will be used for municipal road and bridge capital investments needs;

And that a final summary report detailing expenditures, use of provincial funding and outcomes achieved shall be submitted to the Ministry and the Ministry may request an independent audit of the project; and

Any funds intended for the project that are not used in accordance with rehabilitation of municipal road and bridge capital investment needs or the terms outlined above will be returned to the ministry.

The Council for the Village of Burk’s Falls give a donation in the amount of $ 150.00 to the Almaguin Highlands Secondary School 2008 Graduation Ceremonies.

Rex Smith – Lewis Hodgson:
The Council for the Village of Burk’s Falls have read By-Law 15-2008 being a by-law to adopt a policy on the dedication Parkland or alternatively, cash-in-lieu of parkland for the Village of Burk’s Falls;

And That we authorize the Reeve and the Clerk to sign this by-law and affix the Seal of the Corporation thereto.

Whereas the purpose of the Memorandum of Understanding (MOU) is to formalize a cooperative partnership between the municipalities to share resources for the purpose of developing and implementing a Municipal GIS for the partner municipalities and;
Whereas the MOU will authorize Blue Sky Net to act as the project lead and to enter into vendor, funding and related supplier contracts on behalf of the Municipal Partners, then
Be It Resolved that in order to proceed with the Blue Sky Municipal Geographic Information System Partnership the Municipality of the Village of Burk’s Falls has reviewed and agrees in principal with the articles contained in the Memorandum of Understanding for the Blue Sky Municipal Geographic Information System Partnership.

The Council for the Village of Burk’s Falls have reviewed the Armour Ryerson & Burk’s Falls Memorial Arena/Community Centre budget as presented in the amount of $ 270,400.00; and
That Council approves the budget as presented with Burk’s Falls share being
$ 46,770.00

The Council for the Village of Burk’s Falls has reviewed the Tri R Landfill budget as presented in the amount of $ 149,300.00; and

That Council approves the budget as presented with Burk’s Falls share being $ 44,790.00; and
The Council for the Village of Burk’s has reviewed the Tri R Recycling budget as presented in the amount of $69,700.00;
And that Council approves the budget as presented with Burk’s Falls share being $20,910.00

The Village of Burk’s Falls accept the 2008 Draft Emergency Response Budget of $ 24,411.90 (this excludes the wages line) to follow the cost sharing amounts of 1/3 Armour, 1/3 Ryerson & 1/3 Burk’s Falls.

That we accept the Tender from Klink Enterprise for maintenance of the Municipal flower gardens in the amount of $4,858.96

The Council for the Village of Burk’s Falls accepts the tender from dePeuters
to install new flooring in the municipal office and lobby.

Lewis Hodgson – Ron Russell:
The Council for the Village of Burk’s Falls have read the resolution passed by Tay Valley Township expressing concern with the Evaluation and Approval Process for Provincial funding;

And that we support the request for the province to make infrastructure funding available to all municipalities based upon formulae similar to those developed for the Move Ontario and the Municipal roads and Bridges Fund so that municipal politicians and staff do not have to waste valuable time, effort and money in applying for the various programs’ funds that would enable the construction of necessary projects;

And further that our resolution of support be directed to Tay Valley Township for their presentation to the Provincial government for consideration.

The Council for the Village of Burk’s Falls have read the resolution presented by the City of Ottawa requesting the Province of Ontario pay for MPAC services;

Therefore be it resolved that the Village of Burk’s Falls supports the petition requesting the Province of Ontario pay a proportional share of MPAC costs related to education property taxes; and

That our support be directed to the City of Ottawa for their presentation

The Council for the Village of Burk’s Falls have read the resolution from the City of Port Colborne expressing concern with Ontario Regulation 429/07 under the Accessibility for Ontarians with Disabilities Act,2005 establishes accessibility standards for customer services which apply to ever designated public sector organization, including municipalities, and others that provide goods or services to members of the public or other third parties;
And whereas designated public sector organizations, including municipalities, must comply with the accessibility standards established by O.Reg. 429/07 by January 1, 2010.
And Whereas municipalities must establish policies, practices and procedures governing the provision of their goods or services to persons with disabilities in a manner that respects the dignity and independence of persons with disabilities; enables persons with disabilities to obtain use or benefit from the goods or services; and gives persons with disabilities equal opportunity to obtain, use and benefit from the goods or services;
And Whereas the Council for the Village of Burk’s Falls supports the concerns expressed by the City of Port Colborne and petition the Province of Ontario for the development and provision of a proper and fair provincial funding mechanism to assist municipalities and other provincially funded public sector organizations in complying with the provisions of O.Reg.429/07 so that the financial burden imposed by the Regulations is fairly shared by all the residents of Ontario.
And That our resolution of support be sent to the City of Port Colborne for their presentation to the Province.

That we accept the Accounts Payable in the amount of $ 89,731.11.

Whereas the Joint Building Committee would have one stop shopping for a Building Permit; and
Whereas North Bay Mattawa Conservation Authority currently does not conduct re-inspections of existing septic systems the Joint Building Committee would implement a re-inspection program;
Whereas because of no re-inspection program by North Bay Mattawa Conservation Authority the Joint Building Committee would have better control and enforcement for the prevention of leaching from malfunctioning septic systems into our lakes and rivers; and
Whereas the implementation of a septic system re-inspection program would allow our lakes and rivers to improve and regain sustainability for the reproduction of native fish and species and fish habitat; and
Whereas the Provincial Government’s Source Water Protection Act would be better implemented and enforced; now
Therefore be it resolved that the councils of the Joint Building Committee request that the Provincial Government amend the Ontario Building Code Act allowing the Joint Building Committee for the municipalities of the Township of Magnetawan, Townships of Ryerson, Strong, Joly and Machar and the Village of Burk’s Falls and the Village of Sundridge to conduct and enforce Part 8 Septic Systems as outlined in the Ontario Building Code.

Highlands Economic Development Committee budget as presented in the amount of
$ 70,000.00;
And that council approves the budget as presented with Burk’s Falls share being $ 4,500.00
