THE VILLAGE OF BURK’S FALLS
COUNCIL MINUTES

The regular meeting of the Burk’s Falls Council was held on Tuesday March 27, 2007 at 7:0 p.m. Present were : Reeve Cathy Still and Councillors Ron Russell, Bruce Campbell, Rex Smith and Lewis Hodgson(7:45pm).
Rex Smith declared a conflict regarding the sweeping tender on the agenda and left the table during discussions concerning the same.

Delegations at this meeting included the following:
Leo Boulerice for the opening of the sweeping tenders, Lois Cookman and Pauline Field from the Food Bank. They thanked Council for their donation and gave an update on their program.
Derek Miller – Paul Scargall – Tim Harvey (Pinestone), Greg Lipsett (Loblaws) regarding the commercial development in Armour. They went over the draft servicing agreement between Loblaw Properties Limited and 1653194 Ontario Ltd. and the Village of Burk’s Falls.
Terry Clark from the Welcome Centre. She asked if Council could get another supply of brochures before summer. She would also like the monitor moved from the basement to the office portion of the building.
Jim and Linda McConnell regarding bringing their building into the Village. It can be put on a permanent foundation and hook to Village water and sewer so that it is not a mobile unit.
Gary Binkley – Ontario Street business owners asking Council if they have a four year or long term plan for the Village. He had a letter signed by approximately 25 businesses supporting his request.

That we adopt the Minutes of the February 20, 2007 meeting as circulated.

2007-42
Ron Russell – Lewis Hodgson
That we accept the Tender as presented from 1249057 Ontario Ltd. in the amount of $5400.00 including taxes for sweeping the Village streets as outlined in their tender document. Conflict of Interest declared by Rex Smith.

2007-43
B. Campbell – Lewis Hodgson
The Council for the Village of Burk’s Falls accepts the 2006 Annual Report for the Burk’s Falls Water Treatment Plant as presented to council in accordance with Section 11 of O.Reg.170/03 and O.Reg 247/06 S.10(1) under the Safe Drinking Act.

The Council for the Village of Burk’s Falls accepts the 2006 Compliance Report (Summary Report for the Burk’s Falls Water System) as presented to council in accordance with Schedule 22 of O.Reg.170/03 under the Safe Drinking Act.

2007-45

The Council for the Village of Burk’s Falls have reviewed the recommendations by the Joint Building Committee to include issuing of notices for building without a permit be considered part of the administrative duties of the CBO, and charges or fines received for enforcement of the Building Code Act be paid to the JBC to cover operating costs, less fees paid by By-law enforcement.

And that the CBO is authorized to employ the services of James Mahoney as required for by-law enforcement of the Ontario Building Code.

Therefore be it resolved that the Council for the Village of Burk’s Falls supports the recommendations of the Joint Building Committee.

The Council for the Village of Burk’s Falls have reviewed the resolution passed by the Joint Building Committee at their regular meeting on February 22, 2007 recommending a Wage & Benefit Package for the Chief Building Official effective June 1, 2007.

And that the Council for the Village of Burk’s Falls supports the Wage & Benefit Package as presented.

The Council for the Village of Burk’s Falls approves the following persons to be members of the Burk’s Falls Recreation Council:
Laurie Gionet, Julie Burgess, Amanda Hayes, Angie Dingman, June Crozier.

The Council for the Village of Burk’s Falls have reviewed the 2007 Burk’s Falls & District Fire Board Operating Budget in the amount of $ 175,360.00 with Burk’s Falls share being $ 52,608.00 and the pre-approved Truck replacement and hall renovation budget of $133,000.00 with Burk’s Falls share being $39,900.00. Total Burk’s Falls share for 2007 budget purposes $ 92,508.00

The Council for the Village of Burk’s Falls have read the resolution circulated by the Township of McMurrich-Monteith expressing concern with the lack of funding to our local hospitals and in particular funding for laboratory services;

And that we support these concerns and forward our support to the Township of McMurrich-Monteith for their presentation and collection to the Minister of Health.

The Council for the Village of Burk’s Falls have read the resolution circulated by the Municipality of Magnetawan expressing concern that small Ontario schools are being threatened with closure;

And that we support the Municipality of Magnetawan in their request to the Ministry of Education and Training to revisit the criteria used in determining the sustainability of small rural Ontario Schools to make it more relevant to the rural communities in which they exist;

And therefore our resolution of support will be sent to the Municipality of Magnetawan for their collection and presentation to the Minister of Education.

The Council for the Village of Burk’s Falls have read the Resolution circulated by the County of Huron; and

The Council for the Village of Burk’s Falls supports the County of Huron in encouraging the Province of Ontario to assume 100% of the Ontario Disability Support Program;

And forward our support to the County of Huron for their presentation to the Province.

The Council for the Village of Burk’s Falls have read the resolution circulated by the Municipality of Powassan;

Whereas in November 2006, the M.O.E. released the final Drinking Water Quality Management Standard (OWQMS) under the Safe Drinking Water Act 2002; and

Whereas under this Act, owners of Municipal drinking water systems will be required to obtain a Municipal Drinking Water License; and

Whereas to do so, they will be required to have among other things, an “Accredited Operating Authority” and an approved “Operational Plan” for each of their systems; and

Whereas the implementation of the OWQMS will have costs associated with the ongoing third-party audits, which may range from $ 3,000 to $ 7,000 annually based on system size and geographic considerations;

Now Therefore Be It Resolved that the Council for the Village of Burk’s Falls calls upon the Honourable Minister of the Ministry of the Environment NOT to approve the implementation of “third party audits” considering the clear mandate of an Accredited Operating Authority including other policies, programs and guidelines already in place of proposed to insure that health and safety of our water systems remains at the forefront; and

That we forward our resolution of support to the Minister of the Environment for his consideration.

Council for the Village of Burk’s Falls have read and approve the servicing agreement dated the 27th day of March, 2007 between Loblaw Properties Limited, 1653194 Ontario Ltd. and the Corporation of the Village of Burk’s Falls. Schedule D engineered drawings to be amended.

And that Council authorizes the Reeve and Clerk to sign this agreement on behalf of the Village of Burk’s Falls.

That we accept the tender from the Almaguin News/Almaguin Forester for an ad in the 2007 Summer magazine for the Theatre in the amount of $ 150.00 plus GST.

The Council for the Village of Burk’s Falls donates $150.00 to the Almaguin Highlands Secondary School Graduation Awards Night for 2007.

That we accept the tender from Midwestern Line Striping Inc. provided for pavement markings for the year 2007.

2007-57

The Council for the Village of Burk’s Falls donates $250.00 to the Armour Ryerson & Burk’s Falls Agricultural Society for the year 2007.

2007-58

The we accept the Accounts Payable as presented up to and including March 27, 2007 in the amount of $613354.36 and hereby authorize the Clerk/Treasurer to issue cheques for same.

That we do now adjourn at 2300 until the next regular meeting of Council scheduled for April 24, 2007.
