FALLS
COUNCIL MINUTES
The regular meeting of the Burk’s Falls
Council was held at 7pm in Council Chambers on July 26, 2005. Present
were Reeve Ron Russell, Councillors Bruce Campbell, Lewis Hodgson and
Rex Smith. Cathy Still was unable to attend.
There were no delegations to see Council. Lynette Brooker gave a report
for Council to review on the Welcome Center.
Brian Darnbrough – By-law Enforcement Officer gave his report and
received direction from council on some items.
Len Hall – Village Foreman gave his report.
The following resolutions were passed:
Lewis Hodgson – B. Campbell
That the council for the Village of Burk’s Falls adopts the Minutes of
the June 28, 2005 meeting as circulated and the July 13, 2005 meeting as
read.
Rex Smith – Lewis Hodgson
That the Council for the Village of Burk’s Falls have read and approve
By-law No. 15-2005 being a by-law to set the Tax Ratios for Municipal
purposes for the year 2005.
And that Council for the Village of Burk’s Falls have read and approve
By-law No. 16-2005 being a by-law to set and levy the rates of taxation
for the Village of Burk’s Falls for the year 2005.
And that Council authorizes the Reeve and the Clerk to sign both by-laws
and affix the Seal of the Corporation to each by-law.
Rex Smith – B. Campbell
That the Council for the Village of Burk’s Falls have read and approve
By-law 17-2005 being a by-law to specify the recovery of capped taxes
commercial/industrial protected properties.
And that council authorizes the Reeve and the Clerk to sign this by-law
and affix the Seal of the Corporation thereto.
B. Campbell – Lewis Hodgson
That the Council for the Village of Burk’s Falls have reviewed the
letter from the North Bay Parry Sound District Health Unit requesting a
Property Tax Rebate for Charities on the 2005 property taxes charged at
the Burk’s Falls Health Unit office;
And Whereas the Municipal Act, S.O. 2001, as amended C.25, s.s.361 (1)
states that every municipality shall have a tax rebate program for
eligible charities for the purposes of giving them relief from taxes or
amounts paid on account of taxes of eligible property they occupy;
Whereas the North Bay Parry Sound District Health Unit is a registered
charity under the Income Tax Act, BN 86868 5645 RR0001;
Now Therefore Be It Resolved that the Village of Burk’s Falls shall
process the tax rebate for the taxation year 2005 and forward a cheque
to the North Bay Parry Sound Health Unit.
B. Campbell – Rex Smith
The Council for the Village of Burk’s Falls approves the application to
conduct a raffle lottery as presented by the Burk’s Falls United Church
provided all regulations are adhered to.
Lewis Hodgson – B. Campbell
The Council for the Village of Burk’s Falls approves the application to
conduct a raffle lottery as presented by the Royal Canadian Legion Br.
405 provided all regulations are adhered to.
Rex Smith – Lewis Hodgson
The Council for the Village of Burk’s Falls approves the application to
conduct a raffle lottery as presented by the Burk’s Falls and District
Historical Society provided all regulations are adhered to.
B. Campbell – Rex Smith
The Council for the Village of Burk’s Falls have read the resolution
presented by the City of Clarence-Rockland regarding the borrowing
capacity of Municipalities based on 255 of their previous year taxation
revenues; and
Whereas the calculation of the debt capacity includes debts for public
utilities such as waterworks and sanitary sewers and these debts are
reimbursed through user fees and have no impact on the operations of the
municipality’s general fund; therefore
Be It Resolved that the Village of Burk’s Falls hereby petitions the
Provincial Government to consider amending the formula used to calculate
a municipality’s debt capacity excluding debts of public utilities in
order to allow a municipality to increase the financing of capital
projects which are reimbursed through property taxes;
And That we forward our resolution to the Minister of Municipal Affairs
for consideration.
B. Campbell – Lewis Hodgson
The Council for the Village of Burk’s Falls agrees to pay the two summer
students wages up to September 5, 2005 at the Welcome Center.

We approve the Accounts Payable as presented up to and including July
26, 2005 in the amount of $120,828.06 and hereby authorize the Clerk to
issue cheques for same.

We do now adjourn at 9:40 pm. until the next scheduled meeting of
Council on August 23, 2005.
