THE VILLAGE OF BURK’S FALLS
COUNCIL MINUTES

The last regular meeting of 2004 was held on Tuesday, December 21, 2004 at 7:00 pm. All members of the Council were present.
John Stark – By-Law Enforcement Officer attended this meeting to give his report. Council has requested that he follow up on a couple of these items.
Len Hall – Village Foreman and Water Distribution Operator was present to give his report.

The following Resolutions were passed by Council:

Cathy Still – B. Campbell:
That we adopt the Minutes of the November 23, 2004 and November 30, 2004 meeting as circulated.

B. Campbell – Cathy Still:
That the Council for the Village of Burk’s Falls approves the application to conduct a raffle lottery as presented by the St. Andrews Presbyterian Church provided all regulations are adhered to.

Rex Smith – Cathy Still:
That the Council for the Village of Burk’s Falls places $ 5,000.00 into a reserve fund for the purchase of a new truck when required. This $ 5,000.00 was included in the 2004 budget allocation.

Rex Smith – Cathy Still:
That we accept the tender from the Almaguin News for the year 2005 in the amount of $ 280.00 plus GST.

B. Campbell – Lewis Hodgson:
That the Council for the Village of Burk’s Falls have read By-Law No. 22-2004 being a by-law governing procurement policies and procedures;
And that Council authorizes the Reeve and the Clerk to sign this by-law and affix the Seal of the Corporation thereto.

B. Campbell – Lewis Hodgson:
That the Council for the Village of Burk’s Falls have read and approve By-Law No. 23-2004 being a by-law to regulate the use of Backflow Preventers.

And that the Council for the Village of Burk’s Falls authorizes the Reeve and the Clerk to sign this by-law and affix the Seal of the Corporation thereto.

B. Campbell – Lewis Hodgson:
Whereas under Section 6.2 – Termination of Agreement, the Village Council must give twelve months notice for renewal or termination of the agreement between the Ontario Clean Water Agency and the Village of Burk’s Falls;

Therefore be it resolved that Council for the Village of Burk’s Falls wishes to inform the Ontario Clean Water Agency that the Village is terminating the agreement signed in October and November 2000 as of December 31, 2005.

Cathy Still – Rex Smith:
Be it resolved that the Council for the Village of Burk’s Falls deems that the water line upgrade and installation from Yonge Street to Lofthouse Brass is of highest priority.

And that this be our COMRIF project application.

B. Campbell – Cathy Still:

That the Council for the Village of Burk’s Falls have read the resolution circulated by the Township of Essa concerning the Provincial Government’s promise that the provincial gas tax would be shared with municipalities, but to date municipalities that do not operate transit systems have not received any portion of this gasoline tax, despite the desperate need by small, rural municipalities for infrastructure and roads maintenance funding.

And that the Council for the Village of Burk’s Falls agree that the Provincial Government need to revisit and adjust the formula used for sharing the provincial gasoline tax to include all Municipalities in Ontario.

And that our resolution of support be sent to the Township of Essa.

Lewis Hodgson – Cathy Still:
That the Council for the Village of Burk’s Falls have read the resolution circulated by the Township of Wellington with regards to the Community Reinvestment Fund (CRF) that was implemented in 1998 in order to compensate municipalities for additional costs with services transferred to Ontario municipalities;

And that the Council for the Village of Burk’s Falls supports the Township of Wellington North’s resolution requesting that the Province of Ontario maintain the CRF funding for Ontario municipalities at 2004 levels as a minimum.

B. Campbell – Cathy Still:
That the Council for the Village of Burk’s Falls have read the resolution circulated by the Municipality of West Nipissing concerning the Provincial Government’s announcement of the intention to share the gasoline tax with certain municipalities for fund public transit;

And that the Council for the Village of Burk’s Falls agree that the Provincial government need to revisit and adjust the formula used for sharing the provincial gasoline tax to include all Municipalities in Ontario.

And that our resolution of support be sent to the Municipality of West Nipissing.

Rex Smith – Cathy Still:
That the Council for the Village of Burk’s Falls accepts the Accounts Payable as presented up to and including December 21, 2004 in the amount of $ 161,557.64 and hereby authorize the Clerk/Treasurer to pay these accounts.

Rex Smith – Cathy Still:
That we do now adjourn at 10:00 pm until the next scheduled meeting of Council on January 25, 2005.
