THE VILLAGE OF BURK’S
FALLS
COUNCIL MINUTES
The regular meeting of the Burk’s Falls Council was
called to order at 7:00 P.M. on Tuesday October 28, 2003. All members of
Council were present including the incoming Reeve, Ron Russell. Others
attending the meeting were Doug Clute, the Villages Consultant; Len Hall,
Village Foreman; and Jesse Kohl from the Huntsville Forrester.
Doug Clute attended in regards to the Official Plan Amendment No. 2 and
the By-Law that has to be passed. After the By-Law is passed a copy of the
amendment complete with all schedules and appendices has to be forwarded
to the Ministry of Municipal Affairs for their circulation and approval.
The following resolutions were passed:
Rex Smith - Cathy Still
We accept the tender from Whitmell’s Limited for the supply of winter sand
at the price of $5.00 p/cu yard.
Cathy Still - Rex Smith
We have read and approve the application to conduct a Break Open Ticket
Lottery as presented by the Huntsville Hospital Foundation provided all
regulations are adhere to.
Alex Millar - Bruce Campbell
We adopt the Minutes of the September 23, 2003 meeting as circulated, and
the October 7, 2003 meeting as read.
Bruce Campbell - Cathy Still
The Council for the Village of Burk’s Falls hereby writes off sewer
charges in the amount of $519.75 at Plan 26 N Part of Lot 2 Ontario Street
East side as the property was not connected to
the sewer system.
Alex Millar - Rex Smith
The attached list of water and sewer arrears accounts be written off as
they are deemed uncollectable;
And that these accounts will be placed in the bad debt account.
Alex Millar - Bruce Campbell
We purchase a Wreath from the Vic Fell Memorial Legion for the Remembrance
Day Services in the amount of $57.00.
Cathy Still - Rex Smith
The Council for the Village of Burk’s falls have no objections to the
Santa Claus Parade Committee closing Hwy. 520 Ontario Street from Huston
Street to Yonge Street and Yonge Street from Ontario Street to Centre
Street on December 6, 2003 from 11:30 am to 2:00 pm for the annual Santa
Claus Parade, provided the Ontario Provincial Police, the Burk’s Falls
Fire Department and Ambulance Base have been notified of the closure for
detouring.

We authorize the Clerk/Treasurer to send out Registered Letters to those
persons who are three years in Tax Arrears;
And that Tax Registration Proceedings will begin on Jan. 01/04 for those
person who remain 3 years in Arrears.

We accept the tender from: Stephen Mulligan in the amount of :
$35.00 snowplowing per time, $7.00 snow shoveling per time, $ 10.00
sanding/salting per time
for the 2003 - 2004 season for the Library and Seniors Building.

We have read and approve By-law No. 26-2003 being a by-law to adopt
Amendment No. 2 of the Official Plan for the Village of Burk’s Falls;
And hereby authorize the Reeve and the Clerk to sign this by-law and affix
the Seal of the Corporation thereto.

Whereas a recent proposal suggests that the Almaguin Highlands Detachment
of the Ontario Provincial Police may be moved from the Township of Armour
to the Village of Sundridge or some other regional municipality; and
Whereas moving the OPP detachment north and increasing the boundaries
would involve another electoral district due to recent changes; and
Whereas the primary reason for such a move is the increased work load
caused by the closure of the OPP detachment in Powassan; and
Whereas the Almaguin Highlands OPP detachment have prepared a proposal
(Burk’s Falls Facility Improvement Case 2001) which clearly outlined the
required upgrades to the existing facility; and
Whereas the Council for the Village of Burk’s Falls considers that the
proposal of the existing OPP detachment is more feasible option based on:
- Most of the Almaguin Highlands Detachment’s calls are located in the
South end of the District
- The two (2) entrances to the present detachment from Ontario Street
North and Hwy. 520 allows for greater access in an emergency situation.
- The present location of the Detachment is adjacent to a local health
centre.
- The present location has additional property to allow for expansion.
- Any move to the north will reduce protection to the more southern
municipalities such as Kearney and McMurrich-Monteith.
Therefore Be It Resolved that it is the position of the Council of the
Village of Burk’s Falls that if this move goes forth, we will seek
regional municipal support to explore the formation of a local municipal
police force to properly service the southern municipalities.
By approval of this Resolution we support the Township of Armour in their
efforts to object to relocation of the existing Almaguin Highland Ontario
Provincial Police Detachment and shall forward our concerns to our MP and
to the Attorney General for Ontario. And that this resolution be forwarded
to the Ontario Provincial Police Commander in North Bay and Orillia so
that they may be aware of our local concerns in the hope that the
community may be involved in discussions prior to a decision being made.

Whereas the Council for the Village of Burk’s Falls have reviewed the
correspondence from the Municipal Tax Collectors of Ontario regarding the
Municipal Property Assessment Corporation’s inability to issue a
“Supplementary” or “Omitted” assessments as a result of the registration
of subdivision plans due to the current legislation; and
Therefore Be It Resolved that the Council for the Village of Burk’s Fall
supports the concerns expressed in their resolution;
And that our support be forwarded to the Municipal tax collectors of
Ontario for their collection and presentation to the Provincial
Government.
Alex Millar - Bruce Campbell
Whereas the Council for the Village of Burk’s Falls have reviewed the
correspondence from the Township of Perry expressing concern with the
administration of the POA by the Town of Parry Sound;
Whereas the present problems with the POA have resulted in lost revenue to
the municipalities; and
Whereas the administration problems are bringing the justice system into
disrepute and denying defendants their day in court;
Therefore Be It Resolved that the Council for the Village of Burk’s Falls
shall forward their concerns to the Ministry of the Attorney General and
the Office of the Solicitor General for their investigation into the
current problems with the POA.

The Council for the Village of Burk’s Falls proclaim November 24 to
December 1, 2003 Canadian HIV AIDS Awareness Week, and December 1, 2003
World AIDS day for the Village of Burk’s Falls.
Cathy Still - Bruce Campbell
In recognition of the benefits of high quality child care for young
children’s intellectual, emotional, social and physical development and
later life outcomes;
The Village of Burk’s Falls declared that November 5th, 2003 be designated
as Child Care Worker & Early Childhood Educator Appreciation Day in
recognition of the commitment of child care workers to children, families
and the community.
Alex Millar - Bruce Campbell
We have no objections to Almaguin Minor Hockey Bantam Rep Team conducting
a raffle lottery as presented provided all regulations are adhered to.
Rex Smith - Cathy Still
We approve the application as presented to conduct a Break open Ticket
Lottery by the Vic Fell Memorial Legion Br. 405 provided all regulations
are adhered to.
Rex Smith - Cathy Still
We accept the Accounts Payable as presented up to and including October
28, 2003 in the amount of $225,773.51 and hereby authorize the
Clerk/Treasurer to issue cheques for same.

We do now adjourn at 9:35pm until the next regular meeting of Council on
November 25, 2003.
